NEW ORLEANS PUBLIC SERVICE, INC., Appellee. No. CA 82-162. Court of Appeals of Arkansas. April 5, 1983. Rehearing Denied May 4, 1983. *519 David J. Riffel, Texarkana, for appellant. John A. Neill, Little Rock, for appellee. CRACRAFT, Judge. The appellant, Jim Roberts, appeals the judgment of the trial court which found him guilty of violating the smoking rule of his employment and assessed a fine against him in the amount of $11.50. He contends that the evidence does not support the finding of a violation of the rule and that the fine is arbitrary and excessive. The record shows that the appellant, a laborer for the appellee, was employed to work in a gasoline filling station. The filling station was not a restaurant and no provision was made for food or for beverages other than what was placed on the shelves and in the cooler. As part of his job, appellant was required to check the station and to fill the tanks on a regular basis. It was not unusual for him to work for several days at the station in a row without a break and without refreshments. In the course of his duties, appellant was required to stop at a service station located about three-quarters of a mile from the filling station and purchase cigarettes. Each day he purchased cigarettes in five or six packs. After he returned to work at the filling station, he removed the packs from the cooler and placed them on a shelf in the cooler, or, when he was required to do so, he placed them on the shelves where food and other items were kept. He was never given permission by his foreman to take the cigarettes from the cooler to his own car and was never told that he could not smoke while working. It is undisputed that appellant was constantly exposed to the smoke of other employees in the filling station and was well aware that the tobacco smoke they were inhaling was not their own. He was also constantly exposed to the fumes from the gasoline, and the gas fumes were also carried into the cooler. On the occasion in question, appellant was working alone at the station.
